CIUDAD DE MÉXICO (Sputnik) — El Gobierno de México “invocará el Tratado de Libre Comercio” de México, EEUU y Canadá (T-MEC), en su capítulo 23 que contiene dos apartados, para garantizar el derecho a la vacunación de trabajadores migrantes, sin importar su condición migratoria, dijo el canciller mexicano Marcelo Ebrard.
“El artículo 23.3 sobre derechos laborales establece que cada parte asegurará que los trabajadores migrantes estén protegidos conforme a sus leyes laborales, sean o no nacionales de la parte” correspondiente, dijo Ebrard en conferencia de prensa con el presidente Andrés Manuel López Obrador.
Este capítulo sobre derechos laborales de migrantes en el nuevo tratado que entró en vigor en julio de 2020 “es algo que México cuidó mucho y así quedó establecido” al final de la prolongada negociación que llevó a la actualización del Tratado de Libre Comercio de América del Norte que estuvo vigente desde 1994.
La vacunación no es un derecho laboral, “pero sí es un derecho establecido que el trabajador no debe estar expuesto al contagio”, aclaró Ebrard.
Al aplicarse la vacuna contra el SARS CoV-2, “es una responsabilidad de los dos países garantizar que todos los trabajadores reciban la vacuna, independientemente de su condición migratoria”.
Por consiguiente, agregó: “consideramos que cualquier exclusión de trabajadores mexicanas o mexicanas es una violación del T-MEC en el apartado de derechos laborales, y por consiguiente estaremos aplicando las disposiciones acordadas entre ambos países”.
El canciller comentó que los sindicatos de EEUU anunciaron que pedirán establecer paneles para solución de controversias si México no cumple con las legislaciones laborales, a partir del 21 de enero, cuando comience la nueva administración de Joe Biden.
“Con la misma energía, fuerza e insistencia, le pediríamos solidaridad al movimiento obrero de EEUU, en particular a las nuevas autoridades, para garantizar la obligación del Gobierno de EEUU”, puntualizó Ebrard.
El 20 de enero próximo comenzaría la nueva administración del líder del Partido Demócrata, Joe Biden, tras una prolongada confrontación con el candidato del Partido Republicano, el presidente saliente Donald Trump.
En EEUU viven unos 38 millones de personas de origen mexicano de las que más de 11 millones son se encuentran en situación irregular.
