El alcalde de Nuevo Laredo, Enrique Rivas, evitó presentarse ante un juez federal que lo citó dentro de la investigación por camionetas clonadas de la Marina, caso denunciado en septiembre del año pasado, informaron testigos de la audiencia pública e involucrados.
Explicaron que “fue requerida la presencia del indiciado Enrique Rivas Cuéllar, el lunes 28 de enero en la ciudad de Reynosa, al filo de las 4:15 de la tarde un juez federal lo requirió por el caso de la presunta clonación de camionetas de la Marina, utilizadas para la custodia del entonces candidato del PAN a la alcaldía de Nuevo Laredo”.
Al cuestionar a Enrique Rivas sobre su asistencia a la audiencia ocurrida en Reynosa, Tamaulipas, ante el juez federal el 28 de enero, éste aseguró no tener conocimiento o notificación al respecto.
“A pesar de que Enrique Rivas fue citado y no se presentó a la audiencia, la autoridad federal le asignó un abogado defensor de oficio como marca la ley”, afirmó la fuente que asistió a la audiencia pública.
Mencionó que durante la audiencia, “el juez federal apercibió en dos ocasiones al representante del Ministerio Público Federal, hasta ese entonces encargado del caso, por no realizar diligencias ni avances en la carpeta de investigación desde el 21 de septiembre del 2018 -fecha en la que fue interpuesta la denuncia y hasta el 28 de enero del 2019-”.
La denuncia fue turnada a la Fiscalía General de Justicia del Estado de Tamaulipas, que preside Irving Barrios Mojica, quien hasta hace poco era Procurador del Estado en una designación por demás polémica, el oficio asignado es el FEIDDF-A-VIII-1969/2019 con fecha del 17 de enero del presente año.
En su visita a Nuevo Laredo, el 17 de enero, Alejandro Encinas, subsecretario de Gobernación, habló sobre el caso de las camionetas clonadas.
“Hay responsabilidad municipal, desde el momento en que las camionetas clonadas están en el edificio del palacio municipal. Es algo que tendrá que esclarecer la autoridad judicial”, señaló.
¿Qué dice la ley?
El Código Penal de Tamaulipas, Artículo 171… dice:
Comete dicho delito quien posea o porte, en el vehículo (con) objetos que se utilizan en los vehículos oficiales de instituciones policiales, de tránsito, militares… para igualar la apariencia de los vehículos oficiales.
… Se le aplicará una sanción de siete a quince años de prisión y multa…
… La sanción podría duplicarse por ser funcionario público.
ANTECEDENTES
El 15 de agosto del 2018 elementos de la PGR incursionaron en las instalaciones del C4 -adyacentes al anexo del Palacio Municipal- donde encontraron 2 camionetas con características similares a las unidades de la Marina, pero carentes de registro oficial ante dicha dependencia; estos vehículos son señalados de haber sido utilizados -siendo propiedad municipal- en la custodia de Enrique Rivas durante su campaña por la reelección como alcalde, además de que también son señaladas de haber sido utilizadas en la presunta comisión de otros delitos de desaparición forzada, razón por la que se involucra a una fiscalía especializada en dicho tenor.
