Con 303 votos a favor, 10 abstenciones y 86 en contra, éstos últimos de Morena, PRD y MC, el pleno avaló cambios en los artículos 513 y 515 de la Ley Federal del Trabajo y añadió el 515 bis.
Al argumentar el dictamen, la presidenta de la Comisión del Trabajo, Georgina Zapata, dijo que la actualización de las tablas de evaluación se debe realizar conforme al progreso de la medicina del trabajo, que se incorporen nuevos tratamientos, una adecuada evaluación de los grados de incapacidad laboral, a partir de la identificación y descripción de enfermedades del trabajo, de sus tipos y aspectos.
“Con el proyecto de decreto que sometemos a consideración de este pleno, estamos proponiendo un régimen transitorio para que la Secretaría de Trabajo y Previsión Social expida la tabla de enfermedades y de valuación de incapacidades permanentes en un término de seis meses, contados a partir de la entrada en vigor del decreto que se sirva, en su caso, esta soberanía aprobar, quedando sin efecto la actual tabla de enfermedades y de valuación de incapacidades permanentes”, detalló.
Durante su argumentación a favor, la panista Luz Argelia Paniagua Figueroa dijo que entre las adecuaciones aprobadas se encuentran aquellas que tuvieron como fin el establecimiento de un mecanismo ágil, dinámico y permanente para la actualización del contenido de las tablas de enfermedades de trabajo y de valuación de las incapacidades permanentes.
“No obstante, se conservó el texto del artículo 515 de dicha ley, en el cual se establece que el presidente de la República iniciará ante el Legislativo la adecuación periódica de las tablas de enfermedades”, aseguró.
La panista recordó que han pasado más de 46 años sin que las tablas de enfermedades de trabajo y de valuación sean actualizadas, privando de certeza y seguridad jurídica a los trabajadores que sufren de enfermedades por motivos de trabajo.
“El robo que estos pillos van a aprobar va en contra de los trabajadores. Están violentando sus derechos y que sea el empresario el que diga qué enfermedades se pueden pagar o no, los hace juez y parte y va en contra del trabajador”, sostuvo.
A su vez, el diputado del PRD, Julio Saldaña Morán, explicó que con dicha reforma existe una contradicción, pues aunque se permite que se modifique la tabla, se deja en la Ley Federal del Trabajo otra tabla que solo puede ser modificada por el Poder Legislativo.
Y todavía más, aseguró que lo que se votaría nadie lo conocía:
“¿Quién conoce el proyecto de las nuevas tablas de enfermedades? Que son 73 las que se actualizan. Pero nadie las conoce. Yo no las conozco. Se habla del 2012 (año en que se realizó la reforma laboral), que seis meses después se iban a publicar, cosa que no fue”. Entonces anunció que el voto del PRD sería en contra.
El PRI, mediante David Aguilar Robles, dijo que al actualizar las tablas de enfermedades de trabajo y la valoración de las incapacidades permanentes se garantiza certeza jurídica a los trabajadores. Con el dictamen, añadió, se podrá actualizar la tabla de manera periódica y bajo un mecanismo de cooperación interinstitucional.
Alejandro Cañedo, de Morena, detalló las razones por las cuales su partido votó en contra: “Porque deja solo al criterio del Ejecutivo federal el elaborar la tabla de enfermedades, excluyendo al Poder Legislativo de esta tarea”.
La iniciativa, agregó, forma parte de la contrarreforma de 2012 “cuando se suprimió la tabla de evaluación de incapacidades permanentes, que detallaba el porcentaje a pagar, adicionado al salario, a trabajadores con daños permanentes”.
Y añadió: “Esta iniciativa, que pretende desaparecer la tabla de enfermedades de la Ley Federal del Trabajo, atenta contra la vida de las y los trabajadores e implica que estas enfermedades sean solo una disposición administrativa, vulnerando el ejercicio de este derecho ganado históricamente”.
Incluso, advirtió que “de aprobarse, las aseguradoras privadas que actualmente administran de manera ilegal las pensiones, o el propio IMSS, harán sus propias tablas de enfermedades y de evaluación de incapacidades acorde a sus intereses”.
Peor aún, sostuvo, el dictamen es un golpe a las finanzas del IMSS “pues al no reconocerse las lesiones ni enfermedades de trabajo el instituto no podrá aumentar las primas por siniestro que aplica a las empresas y estos costos se trasladarán a las ramas del seguro de enfermedad general e invalidez”.
Ariel Juárez, de Morena, detalló la razón por la que ya no se pagará el 100% del salario a un empleado: “se pretende que al concluir la actualización, las tablas de enfermedad que están actualmente desaparezcan de la Ley Federal del Trabajo. Su implicación legal es que al salir del cuerpo de la ley reglamentaria del artículo 123 constitucional, se convertirá en sólo una disposición administrativa, lo que significa quitar certeza jurídica en el ejercicio de este derecho”.
Ahora, continuó, será la patronal quien determine qué se reconoce o no como una enfermedad profesional. “Pueden desaparecer o no reconocer patologías causadas por el trabajo, según sus intereses, así como definir la cuantía de las indemnizaciones a que tendrá derecho la población trabajadora que sufrirá o que sufra un accidente o enfermedad de trabajo”.
Y ejemplificó: “si un trabajador sufre la amputación de un dedo pulgar, hoy equivale de 40% a 45% de incapacidad permanente, 45%, el día de mañana podrán decir que solamente equivale a un simple 10%”.
