De acuerdo con información difundida, el 21 de septiembre del 2018 se interpuso una demanda en la sede de la Procuraduría General de la República en Nuevo Laredo, ante la Unidad de Atención Inmediata (UNAI) con número de carpeta 282/2018, dirigida a la FEPADE; sin embargo, fue remitida a la Fiscalía Especializada en Investigación de Delitos de Desaparición Forzada, abriéndose la carpeta de investigación FED/SDHPDSC/FEIDDF-TAM/0000445/2018.
El caso nunca tuvo respuesta, desde octubre a la fecha los acuerdos o diligencias habían sido omisos hasta el pasado 10 de enero cuando se anunció que Enrique Rivas Cuellar deberá presentarse ante un juez federal, asistido por su defensor, el 28 de enero en la ciudad de Reynosa, Tamaulipas, a las 4:15 de la tarde.
El 15 de agosto del 2018, elementos de la PGR, decomisaron de C-4 en esta ciudad, dos camionetas de la Marina, presuntamente clonadas, hecho que fue difundido a nivel nacional y por el cual se abrió en primera instancia la carpeta 282/2018 ante la Fiscalía Especializada en Investigación de Delitos de Desaparición Forzada.
La denuncia había sido presentada por considerar que el candidato del PAN, ahora alcalde, utilizó recursos públicos para su campaña en el proceso electoral.
